Land Transaction Application (LTA) – Update
While working through the State land process with the DNR a revised LTA has been submitted to the State. The revised LTA addresses comments from DNR and the public. The following summary details some of the key items from the revised LTA.
The revised land updates:
- 1665 acres for west surface mine area (Former Hendricks Quarry Area).
- 1,005 acres maintained as direct sale.
- 660 acres revised to be included in a land exchang.e
- 160 acres revised to be included in a land exchange (East Hendricks Township Area).
- 7256 acres revised to direct sale of sub-surface interests only (Proposed Underground Mine Area); Revised to include rights for limited use of the surface of the underground mine area for underground mine infrastructure (e.g. access portals, ventilation, etc.) MDNR would retain ownership of surface of this defined area.
- 801 acres revised to be included in a land exchange (Southeast Hendricks Township Area).
- 50 acres revised to surface easement from the MDNR (Former Option Land).
Other important facts about the transaction:
Public access to the two surface mine areas would be preserved and public uses have been expanded from the original LTA for all areas not under active mining.
The State will retain a perpetual easement on truck/ATV/motorcycle/snowmobile trails. For example; McLeod Truck Trail, Cranberry Lake Road, Dollar Lake Truck Trail.
DNR would have the right of first offer to re-acquire the surface mine lands and underground mineral interests for appraised value after completion of mining and reclamation activities.
- Graymont would perform reclamation at the surface mine areas as originally proposed.
- Graymont revised the agreement to include security bond on the reclamation.
- Graymont will pay a fair market royalty on all limestone extracted from the property (surface and underground mine areas) acquired from the State.
